1. Introduction
Welcome to aCard App ("the App", "we", "our", or "us").
These Terms and Conditions ("Terms") govern your access to and use of the aCard App mobile application and related services.
By creating an account, accessing, or using the App, you agree to be bound by these Terms.
If you do not agree with these Terms, you must not use the App.
2. Description of the Service
aCard App is a digital business card platform that allows users to create, customize, manage, and share digital business cards via a Progressive Web App (PWA) experience.
The App may provide features including:
- Creating and managing digital business cards;
- Adding personal and professional information;
- Adding contact details, social links, images, and other profile information;
- Sharing digital cards with other users;
- Managing and updating card information;
- Storing user profiles and preferences.
As a PWA, the App uses Service Workers to enable offline functionality and improve performance by caching resources locally on your device.
We reserve the right to modify, improve, suspend, or discontinue any feature of the App at any time.
3. User Accounts
Some features of the App require creating an account.
You agree to:
- Provide accurate and up-to-date information;
- Maintain the confidentiality of your login credentials;
- Keep your account secure;
- Notify us of any unauthorized use of your account.
You are responsible for all activities performed through your account.
4. Creating and Sharing Digital Cards
Users are responsible for the information displayed on their digital business cards.
You agree that your digital card content:
- Is accurate and not misleading;
- Does not violate any applicable laws;
- Does not infringe the rights of other individuals or organizations;
- Does not contain illegal, harmful, abusive, or inappropriate material.
We reserve the right to remove content or restrict accounts that violate these Terms.
4.1 Branding on Free Cards
Digital business cards created under the free tier may display aCard branding, logos, watermarks, or other symbolic elements ("aCard Symbolics"). The design, placement, size, style, and presence of these aCard Symbolics are at our sole discretion and may be modified, updated, or changed at any time without prior notice.
We reserve the right to:
- Add, remove, or modify any aCard branding elements on free cards;
- Change the visual appearance of aCard Symbolics in any way;
- Update the style, color, position, or size of any branding elements;
- Introduce new promotional or identification elements on free cards.
These changes may occur without prior notification and will apply to all existing and new free cards. By using the free tier, you acknowledge and accept that your digital card may include aCard Symbolics that can change at any time. Users who upgrade to paid tiers (if and when available) may have the option to remove or customize such branding, subject to the terms of the paid tier.
5. User Content and Ownership
You retain ownership of all content you create, upload, or add to your digital business card, including:
- Name and contact information;
- Profile images;
- Company information;
- Logos;
- Social media links;
- Other personal or professional information.
By using the App, you grant us a limited, non-exclusive, revocable license to store, process, and display your content solely for the purpose of providing the service.
We do not claim ownership of your content.
6. Privacy and Personal Data
Your privacy is important to us.
The collection and processing of personal data is described in our Privacy Policy.
By using the App, you acknowledge that your information may be processed to provide digital business card services, account management, and related functionality.
7. User-Generated Information
Digital business cards may contain personal information intended to be shared publicly or privately.
You are responsible for ensuring that you have the right to publish and share any information you add to the App.
You should not upload personal information about other individuals without their explicit permission.
8. Service Availability
We aim to provide a reliable service but cannot guarantee that the App will always be available, uninterrupted, or error-free.
The service may occasionally be unavailable due to:
- Maintenance;
- Technical issues;
- Updates;
- Third-party service interruptions;
- Internet connectivity or network issues.
9. Third-Party Services
The App may use third-party services, including:
- Supabase for authentication and data storage;
- Cloud infrastructure providers;
- External services required for app functionality.
Third-party services operate under their own terms and privacy policies.
We are not responsible for failures, security incidents, or actions of third-party providers.
10. Acceptable Use
You agree not to:
- Use the App for illegal purposes;
- Create fake identities or impersonate others;
- Upload harmful, malicious, or infringing content;
- Attempt to access unauthorized systems or data;
- Reverse engineer, decompile, or modify the App;
- Abuse, disrupt, or overload the service;
- Use automated tools to scrape or access the service without permission.
11. Intellectual Property
The App and its original content, including:
- Software;
- Design;
- Interface;
- Branding;
- Graphics;
- Features;
are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or reverse engineer any part of the App without express written permission.
12. Account Deletion
You may delete your account at any time.
When your account is deleted, your personal information and digital business cards will be removed according to our Privacy Policy and applicable legal requirements.
Deletion requests can be made through the App (if available) or by contacting us at acardapp@protonmail.com.
13. Disclaimer
The App is provided on an "as available" and "as is" basis.
We do not warrant or guarantee that:
- Digital cards will always be displayed correctly on every device or browser;
- Shared information will always reach the intended recipient in a timely manner;
- Third-party integrations will always function properly;
- The App will be free from errors, bugs, or vulnerabilities;
- Offline functionality will be available under all circumstances.
Users are solely responsible for verifying their own contact information and content.
To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Limitation of Liability
To the maximum extent permitted by applicable law, we, our affiliates, and our service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:
- Loss of business opportunities, revenue, or profits;
- Loss of contacts, data, or goodwill;
- Incorrect information displayed on digital cards;
- Service interruptions or downtime;
- Loss of data caused by circumstances beyond our reasonable control;
- Any damages arising from the use or inability to use the App.
In no event shall our total liability to you for all claims arising out of or related to these Terms exceed the amount paid by you, if any, for using the App.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.
15. Changes to These Terms
We may update these Terms from time to time.
If significant changes occur, we will notify users through the App, via email, or by other reasonable methods.
Changes will become effective upon posting the updated Terms, unless otherwise specified.
Your continued use of the App after changes means you accept the updated Terms.
15.1 Free Card Tier Modifications
We reserve the right to modify, change, or discontinue any aspect of the free card tiers at any time and without prior notice. This includes, but is not limited to:
- Features and functionality available to free card users;
- Storage limits or restrictions;
- Number of cards a user can create;
- Sharing capabilities;
- Any other benefits or services provided under the free tier.
While we endeavor to notify users of significant changes, we are not obligated to provide advance notice for modifications to the free card tiers. Your continued use of the App following any changes constitutes your acceptance of such modifications.
16. Governing Law
These Terms shall be governed by and construed in accordance with the applicable laws of the jurisdiction where the service provider is established.
Users located in the European Union retain all mandatory consumer rights provided by applicable law.
Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts in the service provider's jurisdiction, subject to any mandatory consumer protection laws that may apply.
